Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SiteOpsy website at siteopsy.io and the SiteOpsy application at app.siteopsy.io (collectively, the "Service"), operated by SiteOpsy ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

SiteOpsy is an uptime monitoring platform that allows you to monitor websites and API endpoints, receive alerts when downtime is detected, manage incidents, and collaborate with team members. The specific features available to you depend on your subscription plan.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years of age to use the Service.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized access to your account at security@siteopsy.io.

4. Subscription Plans and Billing

4.1 Plans

The Service is offered under various subscription plans (Free, Starter, Pro, Business), each with different feature limits and pricing. Current plan details and pricing are available on our Pricing page.

4.2 Billing

  • Paid plans are billed in advance on a monthly or annual basis through our payment processor, Paddle.
  • All fees are exclusive of applicable taxes, which will be added as required by law.
  • You authorize us (through Paddle) to charge your payment method for the applicable fees.

4.3 Cancellation

  • You may cancel your subscription at any time through your account settings.
  • Upon cancellation, your subscription will remain active until the end of the current billing period.
  • After the billing period ends, your account will revert to the Free plan.
  • We do not provide refunds for partial billing periods.

4.4 Plan Limits

Each plan has specific limits on the number of monitors, team members, alert channels, status pages, and other features. If you exceed these limits, you will need to upgrade to a higher plan. We enforce limits at the system level to ensure service quality for all users.

5. Acceptable Use

You agree not to use the Service to:

  • Monitor endpoints you do not own or have authorization to monitor
  • Conduct denial-of-service attacks or load testing against third-party services
  • Use the Service to circumvent security measures of any system
  • Transmit malicious code, viruses, or harmful software
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to the Service or its systems
  • Use the Service for any illegal purpose or in violation of any applicable law
  • Resell or redistribute the Service without our written permission
  • Use the Service to send unsolicited communications (spam)
  • Include sensitive credentials (passwords, API keys) in monitored endpoint configurations that could be exposed through alerts or logs

6. Organizations and Teams

  • Organization owners are responsible for the actions of all members within their organization.
  • Organization owners and admins can invite members, assign roles, and manage access.
  • Available roles are: Owner, Admin, Member, and Viewer, each with different permission levels.
  • Invitations expire after 7 days and can be revoked by organization admins.

7. Data and Monitoring

7.1 Your Data

You retain ownership of all data you provide to the Service, including monitor configurations and alert channel settings. We claim no ownership over your data.

7.2 Monitoring Data

Monitoring data (check results, incident records) is retained according to your plan's retention period. After the retention period, this data is automatically and permanently deleted.

7.3 Data Deletion

Upon account deletion, we will remove your personal data within 30 days. Monitoring data may be retained in aggregate, anonymized form for service improvement purposes.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by SiteOpsy and is protected by intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • All errors in the Service will be corrected

While we strive for high availability and accuracy, uptime monitoring is inherently subject to network conditions, third-party service availability, and other factors beyond our control.

10. Limitation of Liability

To the maximum extent permitted by law, SiteOpsy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, resulting from:

  • Your use of or inability to use the Service
  • Any failure to detect downtime or deliver alerts
  • Unauthorized access to or alteration of your data
  • Any third-party conduct on the Service

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless SiteOpsy and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes. We are not liable to you or any third party for any modification, suspension, or discontinuation.

13. Termination

  • We may terminate or suspend your account immediately, without prior notice, if you breach these Terms.
  • Upon termination, your right to use the Service will cease immediately.
  • Provisions that by their nature should survive termination will remain in effect (including liability limitations, indemnification, and dispute resolution).

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.

15. Changes to Terms

We may revise these Terms at any time by posting the updated version on this page with a new "Last updated" date. Material changes will be communicated via email or a prominent notice on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
